The Ford’s Colony Homeowners’ Association commenced an action against Realtec Incorporated, ( Developer of Ford’s Colony) brought on by Realtec’s refusal to repair the continually deteriorating condition of Ford’s Colony Drive.. Realtec owns and has the responsibility to maintain and repair the drive which is the main entrance to Ford’s Colony Country Club
The suit seeks damages to permit the Homeowners’ Association to have the deteriorated roadway and associated areas repaired. The suit was commenced only after protracted discussions between the Homeowners’ Association Board and Realtec were unproductive.
Many questions have been posed to various members of the Ford’s Colony Homeowners Association Board of Directors by residents concerning our suit against Realtec regarding Ford’s Colony Drive.
1. Is the Ford’s Colony Homeowners Association (FCHOA) in financial difficulty?
There is no linkage between Realtec’s “financial trouble” and the FCHOA. The FCHOA is a separate and distinct entity operated by its Homeowners Association Board of Directors elected by its property owners. The Association is financially viable and self-sustaining. It does not have any financial problems and never has.
2. Are the Fords still running the country club?
The country club bankruptcy proceeding has ended. After the owners of the country club (principally the Fords) withdrew their plan for reorganization, Prudential’s (the principal creditor) plan was adopted. The club is now operated and controlled by Prudential through a management company it retained. It is completely independent of Realtec and the Fords. The Homeowners Association has never owned nor operated the country club.
3. Why is FCHOA suing Realtec?
Ford’s Colony Drive is the main entrance to Ford’s Colony. It provides the first impression to all who pass through. Its present deteriorated condition, as set forth in the lawsuit, is inconsistent with the rest of Ford’s Colony and totally unacceptable. The reasons for the suit are to repair the drive, and to assure it will be maintained in the future.
4. Will the lawsuit cost more than it’s worth?
While we cannot at this time go into all the details, rest assured the the FCHOA Board has weighed all factors and shares the common opinion that if successful in the lawsuit, the benefits to our owners will exceed its cost.
