Contingency in Real Estate Contract FAQ Hampton Roads Real Estate

What is a contingency? Black’s Law Dictionary defines a contingency contract as “a contract, part of performance of which at least is dependent on the happening of a contingency.” It goes on to define the word contingency as “an event which may occur” and says that the term contingent, when applied to a legal right or interest, “implies that no present interest exits, and that whether such interest or right ever will exist depends upon a future uncertain event.”

So, in theory when one makes a contract or one’s performance under a contract contingent upon a stated event, then that event must occur else the duty ceases or never becomes operable.

FAQ Warranty on new homes in Virginia

NEW CONSTRUCTION BUILDER WARRANTY PRIMER New home construction builder warranties arise either by implication under Virginia law or by an express provision in the contract between the builder and the buyer.   Va. Code § 55 ‐70.1 implies a warranty in most new home sales regardless whether the contract provides a warranty. Under this statute, a builder warrants for one year that its product is free of structural defects, is constructed in a workmanlike manner, and is fit for habitation. Foundations are warranted for five years.  Of course, the contract may state a better warranty. It also may waive the implied warranty if done in the manner prescribed by the statute. I would strongly caution an agent against being a party to a contract where a buyer waived all builder warranties. FAQ Real Estate Sale Subject to Lease Hampton Roads VA Real Estate

Whose House is it Anyway?

Sales are subject to existing leases. And in fact, sales can be subject to oral leases. That is why a seller signs an affidavit at settlement saying there are no such leases and that no one else is in possession of the property at closing.

It is also why the standard contract obligates the seller to deliver possession at closing. Note, however, that these provisions and documents only serve to give the buyer the right to sue the seller; they do not give the buyer the right to remove a tenant in possession of the property pursuant to a lawful lease.

So, if your listing-to-be has a tenant then you need to request copies of any written leases or a  summary of any oral lease. You should confirm those facts directly with the tenant.

Moreover, you should disclose the existence of tenants in the MLS and you might need to accept offers subject to the tenants terminating their lease and moving out on or before settlement.

Brian, what is the difference between special and general warranty, and should my buyers be worried?

A general warranty seller warrants (promises or guarantees) that he holds clear title to the property and has a right to sell it. This warranty covers (all) problems created back in the chain of title. A special warranty seller, however, basically only promises or guarantees that he has not created a title problem. Obviously then general warranty is better than special warranty.

Question :Who the heck is Mr Williamsburg ? I have searched for properties many times and this name keeps popping up.

Is it okay to strike the general warranty, state of title, and mechanic’s lien clauses from the contract?

FAQ : Brian, the seller wants to change or strike the general warranty, state of title, and/or mechanic’s lien clauses from the contract, is this ok for my buyer?

Answer : No, it is not ok.  Explanation below (and come to the October 13 Roundtable for an even better explanation from First American regarding title insurance!).

The current market has generated more than the usual normal number of institutional sellers such as REOs, institutional investors, relocation companies, foreclosed property re-sales, and simply investor-buyers-turned-sellers.  And these companies seem loathe to take any risk, real or imagined, and since many are out-of-state they are not familiar with Virginia law, custom, or practice.  As a result I am being asked quite frequently whether it is ok, from a buyer’s standpoint, to permit such a seller to strike or change the paragraph or paragraphs that address title warranty, state of title, and mechanic’s liens.  These sellers want to strike that language on the theory that they were not owner occupants and do not want to make any warranties or promises regarding the property; rather, they want to minimize or eliminate any potential liability whatsoever (at least what they perceive as liability).  
 
The REIN contract, at paragraph 8, provides (in part) that:
 
Seller shall convey marketable and insurable title to the property by general warranty deed, unless otherwise specified below, subject to any easements covenants and restrictions of record, which do not adversely affect the use of the property for residential purposes.
 
The REIN contract also provides, in paragraph 7, again in relevant part, that:
 
At settlement, seller shall execute and deliver (i) the deed, (ii) a mechanic’s lien affidavit acceptable to buyer’s title insurance company, and (iii) such certificates and agreements as may be required by state and federal authorities for tax and residency purposes.

First, as a buyer’s agent you simply cannot permit a seller to strike the clear, marketable and insurable provisions of the contract.  If you do then your buyer client has no remedy if the seller cannot deliver clear title – the buyer has to close  with bad title – and a title insurance company will not insure against known defects so that does not help.  Since clear title cannot be delivered and title insurance cannot obtained the lender will not make the loan, thus the buyer can argue that the financing contingency is not satisfied and the buyer need not close, but I worry that in response the seller could point to the language in the contract that says handwritten or notated provisions control boilerplate printed ones.  I think the buyer wins, but having to go to court to find out isn’t exactly what Bobby had in mind. 
 
I am not so much concerned about such a seller striking the general warranty deed clause, or more likely, changing it to special warranty (even to quitclaim).  While it is certainly better to have a seller convey by general warranty, that disadvantage can be mitigated by having the buyer purchase an enhanced owner’s title insurance policy.  However, you must retain the language regarding clear, marketable and insurable title otherwise your buyer may be forced to accept an owner’s title insurance policy with exceptions, that is, the title insurance company disavows any responsibility for insuring against a particular, known, problem.  In the trade we say that they “take exception” to the problem (read: buyer you are out of luck).
 
Lastly, the provision regarding mechanic’s liens is extremely important.  Lenders require affirmative coverage against mechanic’s liens.  Since they are at risk for a problem they cannot discover or eliminate, title insurance companies, including First American (the company we use), insist upon receiving an affidavit from the seller regarding the absence of work by a contractor or supplier for which a mechanic’s lien could be filed or claimed.  Title insurance companies will not issue a policy without it, and since the lender requires it, the net effect is that you simply cannot close the transaction.  This problem was/is acute enough that REIN included the requirement for it in the contract, and the Virginia General Assembly made it Virginia law.  I just concluded a recent transaction where the seller struck this language (and the buyer agreed) and the title insurance company would not insure without the affidavit.  Despite me pointing out the Virginia law that obligated the seller to provide the affidavit, they would not.  After fighting the battle for a couple of weeks we finally reached a reasonable compromise and the deal closed, but it was not a situation that lent itself to agent/broker/lawyer sanity or client satisfaction.  So please do not allow a seller to strike that requirement, and if you are trying to write a deal and the seller wants to strike it, please contact me and I will help you (and the seller) get past that dispute.  
 
Note that the VAR contract has the same language in paragraph 19 regarding the mechanic’s lien affidavit, and similar obligations with respect to title at paragraph 13.  So there is no practical difference between those of you writing on the REIN contract and those of you writing on the WAAR VAR contract.

Answer :

 

 

To be safe sellers should not cancel until the deed is recorded,

the payoff is received, and they have proceeds in hand.

Sellers want to cancel as soon as possible because they get

the balance of their premium refunded. But they should make

sure they are no longer deemed to be the owners of the property

because they run the risk that they will be responsible for a loss

without insurance to pay for it (a house fire for example).

Hampton Roads Virginia First Time Home buyers $ 7500 Tax Credit

 It is surprising to me that there has been little discussion in the news of the recent First Time Home buyers credit of $7500 that was signed in to law in July of this year.I have communicated with many home buyers who were unaware of it’s existence. Sad that such a great opportunity is going unnoticed.

Basically the First Time Home buyer tax credit  reduces a home buyer’s tax liability dollar for dollar up to $7,500 for the purchase of a principle residence that closes before July 1, 2009.  The home buyer would claim the credit on their tax return, and it would offset any tax due that year, up to $7,500.  If the did your taxes and don’t owe any taxes you will receive the full $7500 credit/.

Only first time home buyers are eligible (defined as an individual who has not had an ownership interest in a principal residence in the previous 3 years), and and your income cannot exceed $75,000 for an individual and $150,000 for a couple filing a joint return.

This tax credits,  Unlike most others has to be paid back over a period of 15 years, or when the home is sold, assuming there is equity/ proceeds.  The good news is that no interest is due, so in essence it’s a “free” loan.  In theory  a home buyer would repay $502 each year over 15 years, or reduce his or her tax refund by that amount.

Overall it’s a great incentive for qualified purchasers to enjoy a little extra spending money courtesy of Uncle Sam, ( interest free)  either to spruce up a new home or cushion the new house payment.

I Swear, Agents as Notaries

Your man on the legal corner is quite concerned and has been for some time that agents who are also

notaries are not paying attention to the requirements imposed by that office.

 

A notary acts as an official, unbiased witness to the identity and signature of the person who

comes before the notary for a specific purpose. The person may be taking an oath, giving oral

or written testimony or signing or acknowledging his or her signature on a legal document. In

each case, the notary attests that certain formalities have been observed. The key function is to

be certain that the person appearing before the notary is who that person claims to be. A notary

who fails to perform notarial acts in accordance with the law may be sued for damages caused

by their official misconduct or prosecuted criminally. The employer of a notary may also be

liable for the notary’s misconduct under certain conditions.

The most common mistake I think agents make when acting as a notary is to not require the act

be done in their presence. A notary must have the person sign or acknowledge a pre existing

signature in the notary’s presence. That bears not just underlining but repeating: the act must

be done in the notary’s presence. It is not permissible for you to notarize a signature that was

not signed before you even if you are super ‐duper‐absolutely‐positively‐cross‐your‐heart sure

(the highest legal standard there is, of course) the person you think signed actually signed. So,

for example, it is not appropriate for you to notarize a client’s signature that was signed in

California but not notarized there even if the client tells you over the phone that the signature is

genuine. There may soon come a day when “in one’s presence” will incorporate video

conferencing or Internet cameras, but for now, at least in Virginia, they do not.

 

Another common mistake is that agent/notaries fail to require identification of someone who is

not personally known to them. You may not take a person’s word that they are who they say

they are, and you may not take a third party’s word that someone is who he or she says they

are. That is simply not appropriate. Additionally, if a document or acknowledgement calls for

the person to be under oath (uses the words affidavit or oath or sworn and subscribed) then you

must swear the person in. Frankly, my experience has been that most notaries, not just agent

notaries, frequently ignore this requirement. I realize that it can be embarrassing to ask

someone to raise his or her right hand and swear to tell the truth, etc. but you must do so.

 

Lastly, to resolve one common misconception, Virginia law does not require a notary to own a

seal or use a seal on any document although lenders frequently want them.

What is Value Range Marketing ?

I have to say when I first heard about it the idea of Value Range Marketing in Williamsburg VA it didn’t make sense to me or my clients . A buyer I was working with said why would I offer anything above the lowest price in the range ? I agreed and we made an offer. That in a nutshell is what it’s about. My client would not have even looked at the house because it was priced above their comfort range. The whole idea is to get someone into your listed home. Hopefully they fall in love and then make an offer. If you can get to that point you have started the ball rolling. If they like the house enough you can usually negotiate an equitable offer between buyer and seller. If you don’t then what have you lost ?

A broker in San Diego Ca had a two-bedroom condo that sat on the market for 93 days in 1995 with one showing. Frustrated, the broker , who had heard rumblings about a concept called value-range marketing at an industry convention, got his seller to entertain offers from $120,000 to $150,000. Within 48 hours, the property sold for $137,000.

A decade after the concept of value-range marketing, known as VRM, hit the U.S. real estate market, supporters contend that the marketing strategy draws higher sales prices and happier sellers—as well as helps buyers get into homes they wouldn’t ordinarily think are in their price range. In value-range marketing, the seller sets a price range (i.e., $335,000 to $375,000) instead of just a high price ($375,000). This helps to attract more buyers—since a home set in a range will be within their price range, whereas a home listed only with the high price may not meet their price criteria—as well as generate more offers. The strategy does not obligate sellers to accept any offer. It does allow sellers to entertain and counter offers within the range with an acceptable price and terms, just as they would with a listing that carried a single price.

Prudential Drives the Market

Prudential Real Estate was the first major franchise to adopt value-range marketing, which originated in Australia. It implemented the Prudential Value Range Marketing (PVRM) in 1996 and offers marketing support for its sales associates who use it.

Prudential practitioners in the U.S.  are not the only ones jumping on the VRM bandwagon. The practice is gaining favor with real estate professionals across the country and Canada.

Not Everyone Is Sold on VRM

Ron Rutherford, a professor of finance and real estate at the University of Texas in San Antonio, who co-authored a study on range pricing published in The Journal of Real Estate Finance and Economics, remains skeptical of the strategy.

Rutherford’s study, which used a sample of 5,852 residential houses (176 of which used value-range pricing) in Dallas and Tarrant counties in Texas sold from January 1999 to December 2000, found that range-priced homes took about 4 percent longer to sell and sold for about the same price as fixed-price homes.

It has caused some confusion and maybe that’s due to full explanation by the broker prior to offers. After making a solid offers that weren’t accepted, some buyers have become confused and upset .Some buyers feel that if they’re making an offer within that range, it should be accepted.Some buyers feel like it is a bait and switch, where they are lured in with what looks like a decent price but then told they can’t have that price. So it affects everyone involved in the sale and can leave a lot of negative feelings.

How to Use Range Marketing

There are no set ranges within the industry to price a home. But a seller  should exercise caution in setting a range—selecting too narrow a range can undervalue a home and too high a range can price the home out of the market.

For optimal range pricing, it has been suggested that the end of the scale is close to the seller’s dream price and use a 10 percent to 12 percent spread below the top price to allow for changing market conditions.

The top price of the listing is in the price field and information that the seller will “entertain” or “consider” offers within a set range should appear in the MLS remarks section, the listing contract, and on related advertising and for-sale signs. The home will also appear in an MLS search when searching in the lower part of the price range.

York County VA Neighborhoods of the Year 2008

Three neighborhoods in York County VA. received the 2008 Neighborhood of the Year award.

 

Villages of Kiln Creek Homeowners’ Association  received the award for Safety. The Kiln Creek association was chosen for numerous initiatives that have or soon will result in improved safety for their community, including successfully reducing the level of speeding and hit and run incidents in the neighborhood by posting additional signs about the fines associated with speeding, and installing security cameras to monitor the area and deter would-be criminals.

Kiln Creek also holds regular crime watch meetings and has started an email list to enable crime watch captains and residents to share information when anything happens in the neighborhood.

 Running Man Community Association’s  was selected for the Neighborhood Cooperation and Spirit award. The Running Man association holds many successful community events throughout the year, including a Bicycle Rodeo, an Annual Easter Egg Hunt, Halloween Parade, Annual Yard Sale, block parties and at Christmastime, the Luminary Gift to the County, in which almost 100 percent of the homes participate.

In addition to scheduled community events, residents of the Running Man community are often seen running and walking in their neighborhood, waving hello to neighbors working in their yards. Many neighbors are involved with the Neighborhood Watch program, and several are very active in county service.

Yorkshire Downs Master Association received the award  for Beautification. Over the past year, Yorkshire Downs’ Board of Directors has actively pursued all options within the budget to increase the aesthetics of the community. As well as undertaking ongoing maintenance and repairs within the community, the association has restored a number of areas such as the club house, swimming pool, bridge and retention pond.

One of the larger projects included the installation of new playgrounds and lighting at both the swimming pool and town homes locations. But the largest and most impressive single project is the installation of a walking pier and reinforcement of a bulk head behind Clydesdale Drive. The intention of this installation was to reduce severe shoreline erosion, which has become quite a hazardous issue for residents over time. The walking pier is not only a creative resolution to safety-related problems, but also serves to further improve the appearance of the community.

The York County Virginia Neighborhood of the Year awards program were initiated in 2002 following a request by several homeowner associations to recognize and highlight the efforts of the county’s homeowners to improve their communities. 

I applaud all of these communities for their awards. Being a board member and active volunteer in my own neighborhood Windsor Forest) in  Williamsburg/ James City County VA. I understand how difficult it can be to get things accomplished in a neighborhood.

Question : I think Virginia Beach has the best median household income, at 65K. 3 x 65K (conventional figure) puts the median price around $190K. I think we are at $300K median asking price for the region.

Answer: According to a report I just ran ( sold home prices last 12 months 2007-2008 for the region that includes  Norfolk, Portsmouth, Chesapeake, Virignia Beach, Suffolk, Hampton, Isle Of Wight, Newport News, York , Williamsburg, James City County) the median price was $230,000.

If I run the same report for Virginia Beach the Median Price for sold homes was $250,000. As of point of comparison the median  price for homes sold in 2000-2001 for the Hampton Roads region was $117,995

Williamsburg VA Real Estate “Living in Stonehouse” First person account

The following is excepted from the Stonehouse Gazette a newsletter for Stonehouse residents in Toano, VA I wanted to share it with anyone thinking of moving to the Williamsburg Va area. It gives a great sense of living in the area and relocating from NY.

Playing the role of Adolph Phillipse at the Philipsburg Manor restoration site in Sleepy Hollow, NY, circa 1750, where  he worked on Saturdays as an interpreter is only one of the many facets of Bob Spencer who, with  his wife Carolyn, resides in The Orchard Hill section of Stonehouse in Toano, James City County Virginia Just a few minutes drive from Williamsburg VA.

 This Princeton University and Columbia University Law School graduate’s current activities in the Williambsurg VA area  include Board Member of the Peninsula Agency for the Aging, Board Member of Vibrant Life Ministry, Rotary Club member, Richmond Civil War Roundtable, Christopher Wren lecturer, Williamsburg United Methodist Church, James City County Concerned Citizens, and, of course, the  Stonehouse Board of Directors. This, and more, in addition to a continuing legal practice in Westchester County, New York.

Bob and Carolyn moved to Stonehouse in 2005 after 38 years in Tarrytown, NY. “It took us about 30 minutes to decide to live here,” he said. Having discovered Stonehouse on their own, they were “very impressed” with the look and feel of the community. “We really loved the design of our house and the relatively small lot,  which meant less upkeep.” Compared with Westchester County, the low real estate taxes and the low cost of the golf course were real “bonuses.” ( in the Williamsburg VA area)

What they like best about living in the  Stonehouse community in Toano VA is “the many new friends that we have made, particularly the Orchard Hill group. We also appreciate the country feel of the community and the fact that the developer really did leave many trees.”

In his third year as a member of the Board, Bob says he spends “an average of 10 hours per week” on community business. In his “spare time,” he tries to play golf ( there are 16+ public courses in the Williamsburg Va area)  but says, “My golfing partners have to put up with a lot.” He and Carolyn are looking forward to a family reunion in July, which will be attended by their two biological sons, two adopted Korean daughters, their foster daughter, their Rotary Exchange daughter from Belgium, and their 8 grandchildren.

As Board President of Stonehouse for the past 2 years, Bob’s goal was “to keep residents advised of Board activities as much as possible; to give residents an opportunity to communicate with the Board; and to maintain Stonehouse as a quality place to live.” He is most proud of “guiding the community through the transition from developer control to owner control” and the dedication of so many residents who provide outstanding community service on committees and other volunteer activities.

His long-range goals include “having more resident involvement in community activities of Stonehouse; completing the transition; evaluating resident responses to the Strategic Planning Committee; implementing suggestions that will continue to make Stonehouse a community for all residents, including our children; and working with GS Stonehouse ( The new owner of the undeveloped part of Stonehouse) to develop the overall community.”

FAQ Legal Questions Hampton Roads Real Estate

FAQ: Brian, the seller died before we could close on our home in Hampton Roads, Virginia, can the buyer make the seller’s heirs honor the contract?

ANSWER:  Yes.

The Virginia Supreme Court answered this question in the affirmative in the case of Moore’s Adm’rs v. Fitz Randolph, 33 Va. 175 (1835).  This result is true not only in Virginia, but to my knowledge in all fifty states.  In many jurisdictions the answer will turn on whether the contract contains language stating that it is “binding on the heirs” of the parties.  Curiously, The REIN Standard Purchase Agreement no longer contains that language (the VAR contract still does), but the law (at least it seems in Virginia) presumes that it is meant to be binding on the seller’s estate anyway.
 
Sometimes the seller dies before the deed is executed and so the question becomes: who will sign the deed?  Again, Virginia law provides a pretty clear answer.  Va. Code § 64.1-148 provides that “When any deceased person shall have executed and delivered a bona fide written contract of sale, purchase option, or other agreement binding such deceased person, his heirs, personal representatives, or assigns, to convey any real property or interest therein, his personal representatives may, upon full compliance by the purchaser with the terms and conditions of such contract, option or agreement execute a deed and do all things necessary to effect the transfer of title to such real property or interest therein to the purchaser and such transfer shall be as effective as if it had been made by the deceased obligor.”
 
It may well be that closing will be delayed somewhat when a seller dies (for example, if the seller had not signed the deed you might need someone to qualify on the estate in order to sign the deed), but as you can see it is clear that the buyer can insist and require the estate to conclude the transaction.

Is the reverse true?  Can a seller require a deceased buyer’s estate to perform the contract?  While in theory it is true (the case above refused to answer that converse question), bear in mind the practical nature of our modern contracts – financing based on the buyer’s income not to mention actually being alive, owner occupancy, etc. would almost certainly dictate a different result.  Perhaps if the contract were a straightforward, non-personalized, cash deal one could bind a buyer’s estate.  Otherwise I would say no.

Williamsburg VA New Development Update Burlington Woods

 

Former NFL quarterback Aaron Brooks former NFL quarterback has launched his first  land development project. A 17-acre parcel of land in James City County that will become the upscale Burlington Woods community.

The Longhill Road development is Brooks’ first to get off the ground and he calls it an education in progress that will build his reputation with Peninsula Burlington Woods Williamsburg VAofficials — a stepping stone to greater things.

Brooks will oversee the project through its completion, but Ryan Homes will take over the construction phase once the individual lots are prepped.

Burlington Woods will consist of 26 lots that will be of one-quarter to one-third of an acre. The four to five bedroom homes are expected to be from 2,000 to 4,500 square feet in size. Prices should start in the low $300,000 range Pre-selling the homes should begin with homes completed and closed by the end of 2009.

Colonial Williamsburg VA Neighborhoods

I am planning to move to Williamsburg in the spring, but all the houses I see for sale are in subdivisions. I’m a history buff and I’d like to live where I can walk to Colonial Williamsburg, go to the farmer’s market on Sat, etc. I’ve seen beautiful houses near that area but never see them for sale.  There are numerous subdivisions within a short walk to Colonial Williamsburg and William ans Mary. Most of the homes were built from the late 1980’s and onward. The oldest homes sold that I can find a record of in the last 10 years were all built after 1900. You have to realize when Colonial Williamsburg was restored in the 1930’s.the town was in pretty bad shape. That was the reason  Rev. Goodwin wanted to save the town. He saw it disintegrating…

Colonial Williamsburg Foundation owns most if not all of the homes in the restored area. Two of the homes sold that were early 1900’s were owned by them.

There are a variety of newer neighborhoods within walking distance to the restored area of Colonial Williamsburg and William and Mary.  Port Anne, Holly, Walnut Hills, Yorkshire, Rich Neck Heights, Indian Springs, The Woods, Counselors Close, Richmond Hill are just a few of these neighborhoods.  Walnut Hills is the only one with older homes dating from the 1930’s and up. Prices will range from $500k to $1,800,000.   Although the homes are not older most are Colonials. Some more traditional than others with historic touches throughout.

Queens Lake Williamsburg Va Real Estate

Queens Lake is a wonderful, established waterfront community located in the York County part of Williamsburg, Virginia area. Bordered by Queens Creek to the North and West, and the Colonial Parkway to the South.  Its Eastern border is York Counties New Quarter Park, a 545-acre county park renovated in 2005. Most of the homes were built from the late 1950’s until the lates 1970’s. There are a few that have been built since 2000 on the few remaining lots left in Queens Lake in Williamsburg VA.

Coffee makers, freezers and refrigerators are provided as well.

 A short History Of Queens Lake, Williamsburg VA and the Association

The land bordering Queens Creek in York County Williamsburg VA is characterized by ravines; creeks; mature, mostly deciduous, woodland; and wetlands. It is easy to imagine the Powhatan Tribe hunting and fishing in this region and watching the European Colonists rowing their boats up and down the creek to Capitol Landing to access the new town of Williamsburg.  It has witnessed defining moments in American History, being close to the route that Washington took on his march to Yorktown in 1782, and being at the end of the defensive line that Confederate General Magruder constructed in 1862 to oppose Union General McClellan in the Civil War.  The remains of confederate trenches can still be seen in New Quarter Park and numerous artifacts (arrowheads, military buttons, and musket balls) have been found to bear witness to all of this history.

At the beginning of the twentieth century, there were a number of small holdings scattered throughout the region.  The foundations of a house can be seen close to Queens Creek in New Quarter Park, there was a farmhouse on the bluff that now overlooks the marina, old brick chimneys were found in the Montague Circle area, and there was a farm house on what is now Cambridge Lane.  The land is not well suited for farming, however, and it must have been difficult to eke out a living and also pay property taxes.  The Government took over much of the land along the south shore of the York River, including what is now Camp Peary, New Quarter Park, Cheatham Annex and the Naval Weapons Station.  Between 1925 and 1929, the Chesapeake Corporation, a timbering and paper mill operation based at West Point, purchased three tracts of land south of Queens Creek, known as the Roberts tract, the Hubbard tract, and the Holcomb tract, totaling 814 acres.  In 1927-28 it built the dam across the stream emptying into Queens Creek.  This created a 58 acre lake, that it called Lake Chesapeake. It stocked the lake with bream, bass, and crappie and used the entire property as a hunting and fishing preserve for its executives.  The existing farm house near the dam served as a lodge and was maintained by a caretaker.  In the early 1930s, the Federal Park Service built the Colonial parkway as a reconstruction project after the great depression.  This cut off some of the property but provided access to the road to the dam.

The Queens Lake Development Corporation

In 1950, the Chesapeake Corporation decided to sell off its preserve and it put the sale in the hands of Richard C. Benschoten, a local “Land and Estate” Broker.  Mr. Benschoten, an avid fisherman himself, saw the potential of the land around the lake for home sites so he interested four other businessmen in going in with him on purchasing part of the Chesapeake property.  They incorporated the Queens Lake Development Company on March 14, 1952, purchased 636 acres, including the lake for a total of $75,000 and renamed the lake “Queens Lake.”  After cutting and selling pines and selected hardwoods to recoup half their investment, the Company platted some of the area that was suitable for development with the help of Vincent McManus, a surveyor and vice mayor of Williamsburg; provided for basic road access, electricity, and water; and set about selling the lots. Queens Lake was not developed all at one time, but rather in sections.  As lots were sold in one section, a new section would be opened.  The first section that was developed included the property fronting the west side of the lake. This was followed by the creek front lots near the dam.  Two Williamsburg families and the President of William and Mary, who wanted an “out of town” home, were the first property owners.  There are 19 sections (some being divided into subsections). By the time the Development Company dissolved in 1987, there were 547 lots. Potable water was a problem because the region lies on a thick layer of impervious clay so wells to tap into the water table had to be over 400 ft deep; thus, a contract was negotiated with the Sydnor Pump and Well Company of Richmond to drill two community wells, construct pump houses (adjacent to 210 West Queens Drive and 112 Montague Circle) and lay pipe to serve each lot. Since sewage was not available, each lot had to accommodate a septic field.

In 1961, Mr. Benschoten’s real estate and insurance business partner, Jim Carter, and two bankers bought out one of the owners’ interest in the Queens Lake Development Company.  Shortly afterwards the Company purchased property at the end of East Queens Drive, and what was to become Sherwood and Allendale. Recognizing the value of waterfront lots, it hired Henry Branscome to build the dam to form Princess Pond.

Naming some of the roads after characters and places in the Robin Hood legend was the idea of Stanley Abbott, Superintendent of the Colonial National Historical Park who had been hired to help plan the roads and lots in 1961.  At that time he also laid out a master plan for the recreation area. The National Park Service owned a road called the North Collector Road that paralleled the Parkway.  In 1963 Mr. Abbott, arranged for the Park Service to make the collection road open to all public traffic, pending assumption of maintenance by the Virginia Department of Highways.  That road was officially named Lakeshead Drive. 

In the early part of the1960’s, over the objection of the Company and Queens Lake residents, Interstate Highway 64 was constructed through part of the property, leaving 33 acres cut off from the southwest corner.  In 1965, the company sold the 21 acres of this portion west of West Queens Drive to York County for the construction of Queens Lake Middle School.  As part of this deal, the County agreed to negotiate with the City of Williamsburg to provide water to the Queens Lake Development, connecting to the water pipes already installed by Sydnor. The wells were subsequently blocked off and the pump houses demolished.

When Dick Benschoten died in 1965, Jim Carter was hired by the Company to manage the development of Queens Lake.

The Queens Lake Community Association

From the beginning, Mr. Benschoten had in mind a community with the lake and other recreational amenities being available to all residents and eventually to be managed by the residents.  Accordingly, the “Queens Lake Club” was incorporated on July 7, 1952 with the charter “To regulate and perpetuate the use of facilities provided by the Queens Lake Development Corporation ….”  This was apparently modeled on a similar arrangement at “Smoke Rise,” a residential community in New Jersey.  Mr. Benschoten became president and remained so until his death in 1965. The sales contract for purchase of a lot from the Company required that the new owner must be accepted as a member of the Queens Lake Club. Resident dues were set at $10 per annum.  Standing committees for membership, building, finance and lake were established.  At a special meeting of the Queens Lake Development Company on June 29, 1953, it agreed to deed the lake and surrounding land up to 2 feet above the high water mark to the Queens Lake Club, Inc.  Shares of stock were issued to the partners of the Company on the basis of available acreage, with a share being issued to each new property owner as it was subtracted from the holdings of the partners. In this way, ownership of the assets of the club gradually transferred to the residents. In 1960 the Company deeded 11 acres of land on the east side of the dam to the Club and contributed $60,000 for recreational purposes including the construction of a swimming pool, two tennis courts, dock, and bathhouse.  The first swimming pool was opened in 1961.  Fees for its use were set at $50 per family.

In 1966, membership dues were $12 per year. Swimming fees were $65 for resident and $75 for non-resident families. In 1968, 200 families lived in the community and 143 lots remained to be sold.  Jim Carter negotiated the purchase of the 54 acre Holloway tract (Bowstring, Shoreham, Cambridge, and Holloway) for $3,000 per acre. Because half the tract was still in open fields, Carter planted hundreds of pine seedlings to provide an eventual wooded cover in keeping with the rest of the neighborhood.  There was some resistance to including residents of this area in the Queens Lake Club, partly because of perceived overcrowding of the existing swimming pool.  The Development Company offered to provide 30% of the cost of constructing a second pool in return for admitting this tract into the community and the members of the Queens Lake Club agreed.

In February 1969, Major General Briard Johnson was elected the first president of the Club who was not a principal of the Development Corporation. He was a strong proponent of the philosophy that individual amenities of the club (Pool, tennis courts, marina) should “pay for themselves.”  The initiation fee was raised to $160 for new lot purchasers. Swimming fees were $75 for resident and $110 for non-resident families. The second pool opened on May 30, 1969.  The By-Laws were revised to provide for one share of stock for initiation fees paid. All previous stock was cancelled and a new issuance of stock certificates was made.

Over the years the Club maintained the two pools and bathhouse, expanded the original two tennis courts to four, enlarged the marina from a landing on the creek to the present configuration of outside and covered slips as well as a launching ramp, and in 1980 constructed a clubhouse. In 2001, the original pool overlooking the creek was demolished and a new six-lane pool was constructed.

One of the original standing committees was the “Building Committee” which was to ensure that construction and subsequent modification of houses conformed to certain standards.  As an example, minimum living space areas were established for single and multiple story houses.  Conformance to the standards was enforced under threat of loss of privileges.  Over time, new construction dwindled, and the Building Committee ceased to exist as a standing committee.  The By-Laws provide for the appointment of a Building Committee if an occasion demands it.

Jim Carter sold the last lot owned by the Queens Lake Development Company in 1985 and he vacated his seat on the Queens Lake Club Board of Directors in 1986. The Queens Lake Development Company was dissolved on September 1, 1987.

Since the early 1960’s, one Saturday each year has been set aside as “Queens Lake Day.” Since the bicentennial in 1976 it has been held close to the 4th of July. Typically, there is breakfast in the clubhouse and the festivities are started by a parade along East Queens Drive to the recreation area led by the County Sheriff and followed by fire and ladder trucks, sirens blaring.  Most years there is a theme, and the marchers and bicyclists dress accordingly.  Scouts raise the flag and the QLCA President makes a welcoming speech. The rest of the day is devoted to sports events, friendly competitions, and children’s games.  In the evening there is a community picnic around the pool and dancing to a live combo.

A periodic newsletter providing updates on community activities and issues of concern to residents has been published since the early 1970’s. In addition, the club house has been used for hundreds of community functions, social events, and educational activities.

Over the years the Club has represented the residents of Queens Lake in a number of controversial issues, including: a proposal to construct high-density housing on a portion of the property; a proposal to construct a highway crossing of the York River adjacent to Queens Lake; a proposal to develop a golf course in New Quarter Park; noise abatement along the I-64 corridor; repair of the road across the dam following storm damage; and, more recently, upgrade of electric and water supply, and installation of a county sewage system.

In 1995, the Board decided to contract for a Facilities Condition Survey and a plan to maintain and improve Queens Lake Facilities over the next 10 years. The survey was conducted by the DeYoung-Johnson Group, Inc and addressed the clubhouse, pools, marina, and tennis courts. The resulting report, referred to as the DJG report, projected expected expenses for the ten year period.  It noted that the main swimming pool had deteriorated and was in need of extensive repair. On the basis of this report, the Association voted to increase maintenance dues to provide for expected expenditures.  In the spring of 1997, a survey of members was conducted to ascertain the interest in maintaining the swimming pool complex and later that year the DJG prepared a report outlining three options for it.  In 2000 the membership voted for the option to replace the pool and agreed to borrow some of the money required to do so rather than use reserve funds set aside for other purposes. The dues were raised by $100 per year to cover this expense.

In 2002, under its then president, Don Tortorice, a new class of membership was proposed.  In return for signing a restriction on their deed, binding them and all successive owners of their property to membership in the Club, the owners of a Queens Lake property could join with only a nominal stock purchase fee and be charged reduced maintenance dues (Whereas a “traditional member” paid $1,000 stock purchase fee upon joining and $310 per year in dues, a “deeded member” would pay $100 stock purchase fee and $250 maintenance dues.)  The Board pledged that they would not file any of the deed restriction documents until 130 had been received.  This number was surpassed in 2003, and the deed restriction documents were filed.  This duel class system is still in effect and appears to be working quite well. The dues have been constant under this arrangement for four years. Currently, out of 347 members, 190 are “deeded.”  Under the deed restriction program, the association retains 100% of owners of “deeded” properties, so this will gradually raise the overall retention rate and provide a solid base of permanent members to maintain the common property. 

At the annual meeting of 2003, the name, “Queens Lake Club, Inc.,” was changed to the “Queens Lake Community Association, Inc.” in order to emphasize its role as a guardian of the common property and representative of the residents — and to avoid the connotation that it was merely a social organization. The articles of incorporation were changed to reflect the new name in early 2004.

Hampton Roads/ Williamsburg Va Real Estate. Reasons homes are not selling

A few reasons homes are not selling in Williamsburg/ Hampton Roads Va1. Unrealistic List Prices.  A large percentage of the homes on the market are overpriced for what people are willing to pay for them,” 

A lot of sellers are pricing way to high from the start. They are then adjusting their price and coming down. Sadly they keep chasing the market downward behind the curve.

2. The First Offer is Often the Best Offer. There’s a reason this is a real estate cliche. If you get an offer in today’s market,  try to make the best of it , negotiate and live with it if you can, because there may not be another offer for quite some time. 

3. Don’t let your house get stale  The longer a house is on the market, the less attractive it appears. Consumers are watching the market very intently these days. A common thought is :If no one else has bought this house in 12 months or longer, why would I want it ? What’s wrong with it ?

Homeowners sometimes try to get around this problem by allowing a listing to expire and then re-list the house to start the clock ticking again. The  (MLS) multiple listing service ( WAAR/ Williamsburg Area Association of Realtors, REIN/ Real Estate Information Network, CVRMLS/ Central Virginia Regional MLS, CBRAR/ Chesapeake Bay and Rivers Association of Realtors ) will classify it as a new listing-but real estate agents who know the area will usually recognize that it’s the same old house.

You won’t  fool many people . Better to price it right from the start to get it sold quickly and prevent the staleness.

4. Listen to the feedback. 

If a common response from showings is ” It needs new carpet ” Then install new carpet or paint the interior, remove the wallpaper or any other common feedback responses

5. Go For the HGTV Look.

Quite a few of today’s home buyers in Williamsburg and Hampton Roads VA are seeking perfection in the home they will buy. That’s hard to do in some older homes. An older home is not going to be modern like those home design shows.

Numerous buyers ( maybe all) are watching the endless stream of design shows on HGTV these days. It is shaping their expectations.

While that doesn’t  mean you have to put in granite counter tops and new kitchen cabinets, although not a bad idea. You do need to clear the clutter and make the place spiffy.

Quite a few homes that I have shown to buyers in the Williamsburg and Tidewater Va area look like they just appeared on an HGTV segment. Even homes selling in the $190k-$250k price ranges. Use contemporary colors, buy a few accessories at Target. Hide your personal things.“

6.. Don’t Expect a purchaser to Renovate. Yes, there are people who visit Lowe’s/ Home Depot daily and love to do projects around the house, painting , building decks, hanging light fixtures, installing new flooring. But most of today’s buyers want to move in and live. With so many homes to choose from they will normally pick the one that needs the least amount of work/fix up, etc. Even in a good market, fixer-uppers attract only limited offers because people just don’t have the time. money or energy. The people that do have the time will expect a really low price.

7. Understand Buyer’s Mentality.  Quite a few sellers currently think buyers are being greedy. In fact that’s not normally the case. Quite a few of today’s Hampton Roads home buyers are frightened. A major concern is fear of home values in the Tidewater VA area will decline after they purchase. A number of buyers won’t  have the courage to buy a home unless it’s better than the other homes currently on the market and it’s irresistible to them.

8. Play to Strength’s of your Home. Is it on a busy street ? While some think that’s a turnoff others will not mind. If it is make sure your overall curb appeal is enticing. Try to bring in those people driving by with beautiful landscaping. It’s amazing what a few hundred dollar investment in plants and much can do for the curb appeal of a home.

9. Lack of Pictures/ Poor online marketing.   Look up your home’s address in Google. www.Google.com

 Do you see multiple websites that your home is being marketed on ? Is it on www.Craigslist.com ?, Point2 Are there enough pictures to get a good overall sense of the home ? What about the community ? Any pictures of the neighborhood amenities ? The pool, trails, playgrounds, golf courses ? Is it featured on www.Trulia.com , www.Zillow.com , Google Beta or many others ? Does the description of your home make you want to buy it ? Is your home a ” Featured Listing on Realtor.com www.Realtor.com  Are there 25 pictures of your home on Realtor.com ? IS their a descriptive story about your home on Realtor.com ?

10. Lack of an agent’s or brokers online presence. Google your agent. www.Google.com  Is he or she featured on multiple websites, blogs, etc ? Web presence can be compared to the Yellow Pages. Which business will be more successful. One with no yellow page listing or one with 1000’s of yellow page ads’ that cover the entire world ? Imagine if you could advertise in every cities’ yellow pages ? How many cities are there in the U.S ? That’s the power of the web/ Internet…

Moving/Retiring to Willamsburg VA For young and old alike !

I wanted to share an excellent post by by Andrew Petkofsky for Virginia Business. I have added a few links to direct you to areas of information.

Ken Carr retired to Williamsburg because he didn’t want to get away from it all. As a sales and marketing executive in the fashion industry, he had enjoyed a fast-paced career and was looking for a gentler climate than his home in the Chicago suburbs.

But nice weather and recreational options were only part of it: Carr also hoped for opportunities to keep busy and take on new challenges. “You spend your life working, as many of us have, five or six days a week with the pulse of business,” he says. “To just have that stop, psychologically, I didn’t find that it was all that appealing.”

When Carr moved with his wife, Nancy, to the gated community of Ford’s Colony in 1999, he immediately occupied himself building a retirement house. Someone asked if he would sell it, so he built another.

Then he became increasingly involved sharing his business experience with those just starting out. Carr connects with business clients through the Service Corps of Retired Executives, a national program coordinated locally through the Greater Williamsburg Chamber & Tourism Alliance. “It’s a great way to use the expertise that you have,” says Carr, who is 65. “It’s also an incredible opportunity for businesses or organizations to get people who are very accomplished to assist them — the kind of team that quite frankly they couldn’t go out and hire.”

In fact, so many former executives and high-ranking military officers have retired to Williamsburg that a number of other organizations, including the College of William & Mary and its Mason School of Business have created local programs to harness their expertise.

The post-career challenges are not reserved solely for former captains of industry. Other retirees in the area take classes in a large continuing education program, teach in the same program and even help operate a professional chamber orchestra in Williamsburg. “We wind up with some very bright early retirees who still want to make contributions,” says Keith Taylor, director of James City County’s office of economic development.

The Williamsburg area (including James City County and upper York County) has become a retirement mecca. Money magazine named the region one of the country’s best places to retire. The magazine cited attributes such as the area’s history, culture, green space and access to health care and airports.
The area’s growing reputation among retirees has been helped by a constellation of attractions including the Colonial Williamsburg living history museum, the College of William & Mary, award-winning golf courses, a handful of prestigious gated communities, close access to tidal rivers and the ocean, and a location only three hours away from Washington, D.C.

As the retirement-age population grows, older residents are redefining the options available for their golden years and, in the process, reshaping the community. Kingsmill on the James, opened in the 1970s as the region’s first gated community, now has the company of several other retiree-friendly residential areas protected by gates or private security forces. These include Ford’s Colony and The Governor’s Land at Two Rivers.

 Two recent arrivals, Colonial Heritage and The Settlement at Powhattan Creek in James City, requires that residents be 55 or older.

A boom in mixed-used developments also appeals to the preferences of an older population. These projects group shopping, restaurants and low-maintenance residences such as condos and town houses in one location. “Folks are looking more and more at access to retail and entertainment within walking distance of their homes,” says James R. Golden, associate vice president for economic development at William & Mary. “The retirement community is sort of a leader in this.”

Golden helped promote the development of New Town, a mixed-use community just outside Williamsburg. Now a second, similar development, High Street, is under construction in the city. Riverside Health System also has proposed a mixed-use community, Quarterpath at Williamsburg, which would include a hospital, a nursing home and housing. State approval has not yet been granted for the hospital, which would be the Williamsburg area’s second.

Community leaders see the retirement boom as a largely positive economic force that may create jobs for younger folks in areas such as health care, retail and other services. The officials point out that many of those retiring to Williamsburg from other areas, especially the Northeast, are well-heeled professionals and business executives who have chosen to end their careers while still in their 50s. “When you develop a vibrant retirement community … they will pay for services that they want and appreciate, and that will open up opportunities for people that want to fill those needs,” says Richard Schreiber, president and CEO of the Greater Williamsburg Chamber & Tourism Alliance.

One side effect of becoming a retirement mecca is that land and housing prices in the region have risen to levels beyond the means of many workers in service jobs. “It’s sort of creat­ing a greater shortage of affordable housing,” says Rick Hanson, James City’s director of housing and community development. “A lot of people that work in James City do find the housing costs prohibitive, and they will commute in.”

The cost of housing can also be a problem for some retirees who spent their working years in the community. But local governments are trying to solve the problem. Hanson’s office recently assembled a parcel for development of low-rent senior housing in cooperation with a local nonprofit organization. He says the county also has commissioned a consultant to analyze housing needs and report this fall.

Numbers help tell the story of Williamsburg’s growing popularity as a place to retire. William & Mary and the Center for Excellence in Aging and Geriatric Health, a local organization created to promote the health of older people, reported in 2003 that the 60-and-older population in Williamsburg, James City and upper York grew more than 65 percent, from 5,688 to 10,686, between 1990 and 2000. The 60-and-over population in Virginia as a whole grew 17.1 percent in the same period. Growth in the same group nationwide was 9.4 percent, according to the study, which was based on U.S. Census figures. During this same period, the area’s overall population grew about 27 percent, from 54,980 to 69,763.

Pete Williamson says he retired in Williamsburg partly because the city and its surroundings seem just as full of families and younger people as folks of his generation. Even his affluent Governor’s Land neighborhood seems to be attracting a good number of families, he says. “We have a community with a mix of young and old with school kids and retirees,” Williamson says. “We’re not some retirement community out in the middle of nowhere where you have to drive a half hour just to go to a grocery store.”

Williamson was living in Wilton, Conn., and working as an IBM program manager when he retired in 1994 at the age of 54. A volunteer job with an ambulance corps became full-time work before he and his wife moved to Williamsburg in 1998.

Now 67, Williamson co-leads a 40- to-60-mile bicycle ride for the local bike club ( Williamsburg Area Bicyclists) once or twice a week. He also serves on the board of his neighborhood’s homeowners association and does computer work as a member of a charity tennis group that raised about $45,000 last year for a local hospice.

It’s hard to pinpoint the exact size of the region’s retirement community because there’s no set age for retirement. Louis Rossiter, a former Virginia secretary of health and human resources who’s now director of community health service research for the Center for Excellence in Aging and Geriatric Health, says Williamsburg may serve as a model in developing programs that can be adopted elsewhere.

Thinking ahead is important, says Rossiter, because an older population brings potential problems along with benefits. “When the retirees move here, they’re in good health. Then they age in place,” he says. “Who will take care of them as they become more frail?”

The Center for Excellence is a consortium of colleges, hospitals and health agencies that conducts sponsored research into such subjects as Alzheimer’s disease and arthritis, and studies ways to improve access to medical care. More significant for local retirees, the center also offers geriatric services not generally available in the community, such as memory assessment and driving evaluation.

For high-ranking military retirees, Williamsburg offers something beyond resort communities and golf courses: easy access to Washington. “Lot’s of people continue some kind of consulting but don’t want to live in D.C. — they’ve had that experience,” says William & Mary’s Golden, himself a retired Army brigadier general.

Local organizations increasingly are coming up with ways to capture the interests of these retirees and take advantage of their skills. The Mason School of Business at William & Mary, for example, enlists 90 retirees in its Executive Partners program as mentors for students and faculty and as consultants to companies looking for advice. “The joke is they come, play golf six months and get bored,” says Jonathan Palmer, the school’s associate dean. “We engage them at a very high and active level.”

In addition to mentoring others, Williamsburg retirees are interested in learning something new. William & Mary’s Christopher Wren Association, an education program for retirees, attracted more than 1,400 students last semester to more than 60 classes. Retirees served as faculty for many of the classes.

The Chamber & Tourism Alliance last year began a Community Leadership Service in which 16 retirees who moved to the community recently took a crash course about the region, its governmental structure and inner workings. Participants now are creating a database of retired people with skills that could benefit local nonprofit organizations, says Schreiber, the chamber president.

Leading the database project is Joan Peterson, who was recruited because she chaired the education committee of the Williamsburg Symphonia, a professional chamber orchestra. Peterson moved to Williamsburg from Massachusetts when her husband took early retirement from Hewlett-Packard. She had been director of summer programs for a private school. Now a bit more than four years later, her husband is commuting regularly to consulting jobs in Minneapolis and Seattle, and she is immersed in a project she hopes will benefit nonprofits and retirees. “I absolutely love Williamsburg,” says Peterson. “I would have a hard time coming up with things I don’t like about it. Except maybe for the rapid growth. Everyone wants to be the last one in, I guess.”

Living at 9 Winster Fax, Williamsburg Va in Kingsmill is like living in the middle of a park.  On one side is a large rolling lawn. Kingsmill Golf Williamsburg VA

    Kingsmill’s River Course is 30 years old and is the best known of the three – the other two are the Plantation and the Woods.  The men’s tees play to a mild 6,325 yards with a rating of 70.9 and slope of 133. This course is home ot the annual Michelob ULTRA OPEN LPGA Tournement.
 
    The River course is not tough but it is thoroughly enjoyable. Pete Dye ( course designer) tucks plenty of bunkers close to the greens, dearly penalizing any offline strikes.  However, the greens are more than amply sized, 46 yards deep on a few of them, including the finisher which features nasty narrow traps along the entire left side and an even nastier one, because it is small and deep, at front right.  From the men’s tees, #18 is not long (362 yards) but the drive, over water and two traps 180 and 212 out on the left, must be perfect to have a straight-in approach to a narrow entryway to the green.

    If there is signature hole on the River course, it is #17, the only hole that plays along the James River.  The green is enormous, a full 50 yards deep and guarded on the right side by a small bunker front right and a longer one beyond it that runs the rest of the length of the green.  The only bailout area is short and left, but hit too long on that side and you will find yourself in gnarly grass with a downhill lie from a steep bank.  On the card, the 17th is the easiest hole on the course, but choose the wrong club and bogey is likely.

    The Plantation is an Arnold Palmer design that plays to 6,430 yards from the tips, with a rating of 71.6 and slope of 127.  It is considered the least challenging or interesting of the three courses.  The Woods course, a Tom Clark/Curtis Strange design, is the only layout at Kingsmill without homes in sight.  It features a parkland style with some deep ravines and a quirk or two; for example, one double green features a sand bunker at its core.  As for degree of difficulty, The Woods’ ratings and slopes at the tips and men’s tees fit between the Plantation and River Courses.

    There is one more course at Kingsmill, a nine-holer that Golf Digest once called, “The most opulent pitch and putt in the country…”    The Bray Links is a short course wedged between the resort’s conference center and the James River.  It has the best views of the river of any of the courses and is typically in excellent condition, with bent grass greens and Bermuda rough that is tended  regularly by the same keepers of the other courses.  It is a great place to hone your short game.

KINGSMILL’S VA HISTORY

 

 

Steeped in a tradition of gracious Southern hospitality, Kingsmill heralds a rich history dating back to Colonial America. The bucolic land located along the banks of the mighty James River was considered as a permanent base when encountered by the Englishmen on May

 

12, 1607

. They decided to settle at Jamestown the next day. Located in the heart of Virginia’s Historic Triangle, it should come as no surprise that the land now known as Kingsmill featured a bustling Virginia plantation from 1619 through the 1800s.

Today, Kingsmill retains those magnificent traits inherent in Kingsmill’s early days with grand accommodations, gracious hospitality and stately service.

Kingsmill played a significant role in the growth and development of the Jamestown colony. When the first settlers arrived in Virginia, colonist Gabriel Archer proposed to his fellow pioneers to consider the currently-named Hope section of Kingsmill their new home. Thought to be a true paradise and idyllic locale for their homesteads, the settlers eventually made their home slightly west at Jamestown, which permitted their ships to anchor closer to shore.

More than a decade later, the first 300 acres of Kingsmill would be settled by

 

 

Richard Kingsmill

, a member of the Virginia Company, an organization chartered in England and charged with the founding and settlement of Virginia.

Several other early colonists played a significant part in the development of Kingsmill and the growth of nearby Williamsburg VA.

 

 

Col. Lewis Burwell III

was a member of the Governor’s Council, the first elected legislative assembly of the new world. He inherited his grandfather’s lands and built Kingsmill Plantation, titling it after the original owner.

Col. Thomas Pettus

was a prominent land owner and also served on the Governor’s Council. After his death, Pettus’ lands passed to James Bray II, his widowed daughter-in-law’s new husband.

James Bray II

was one of the first legislative representatives for the new City of Williamsburg and acted as a Burgess and Justice of the Peace for the County.

These brave new adventurers carved out a gracious existence along the banks of the mighty James River. The foundations of several notable historical sites can still be found at Kingsmill Resort & Spa.

Kingsmill Plantation

Col. Burwell’s Kingsmill Plantation was at the core of a thriving, small riverbank community with its own compilation of mansions, outbuildings and slave quarters, as well as an attended ferry landing and flourishing population.

The Plantation’s grand mansion was situated on the current Plantation golf course and overlooked the majestic James River. The 4,800-square-foot manor house was two-stories tall, built of brick and contained eight rooms. Granite stairs manufactured in Wales lead to two acres of beautiful terraced gardens on the river side of the mansion.

The plantation also included two brick dependencies, a coach house, dairy, stable, barn and two wells. Although the main house was destroyed by fire in 1844, the two flanking dependencies and original garden steps remain. These buildings can be viewed on the second hole of the Plantation Course.

Burwell’s Landing

Col. Burwell also established the Burwell’s Landing ferry and warehouse. This water landing became a major port of entry for Williamsburg during the 18th century and played a significant part in the American Revolution. The site is visible from the 17th golf hole of Kingsmill Resort’s River Course.

Burwell’s Ordinary

As Burwell’s Landing grew in commercial importance, it developed into a social hub with the operation of the Ordinary at Burwell Landing. The Ordinary at Burwell Landing provided travelers with entertainment, horse stables, storage and supplies. This site can be visited on the River Course’s 17th hole.

Pettus Plantation

Col. Pettus built his plantation in the 1640s and titled it Littletown Plantation. A profitable tobacco plantation, it was located on property now featuring Kingsmill Resort’s marina. Littletown Plantation’s manor house encompassed six rooms, several outbuildings and a well, all of which are marked at the site.

Bray Plantation

Around 1700, James Bray II constructed a brick house flanked by out-buildings overlooking the James River. The substantial foundations of this home still stand today and the main house, dependency and well are located on the path between the resort center and the spa.

William M. Kelso, Ph.D., director of Archaeology for the APVA Preservation Virginia and author of

 

Kingsmill Plantations,

wrote about the excavation at Kingsmill. “The study at Kingsmill, where numerous plantation sites represented the entire social and economic range of plantation life in colonial Virginia from her earliest years, promised to reveal for the first time substantial archaeological information about country life,” he wrote.

Ever cognizant of environmental and historical issues unique to Williamsburg and the Kingsmill lands, Anheuser-Busch is committed to preserving and maintaining the historical record of Kingsmill’s history. Artifacts from the excavations are on display at the resort’s conference center, the Jamestown Settlement museum, Historic Jamestowne and at the Virginia Historical Society in Richmond. In addition to the preservation of historical sites throughout Kingsmill, the names of original settlers have been preserved and incorporated into the naming of streets and subdivisions within the resort and in the residential division Kingsmill on the James.
