One of two homeowner cases against Realtec has been resolved successfully. At a hearing on Thursday, July 19, 2012, the Court granted a Motion for Summary Judgment against Realtec. The Court agreed with the Fords Colony Homeowners Association’s position that Realtec did not have the unilateral authority to re-designate Ford’s Colony Drive from “Reserved Area” to "Common Area" by which Realtec was attempting to force the FCHOA to accept financial responsibility for Ford’s Colony Drive in its “as-is” condition. According to the Declaration, Realtec has the financial obligation to maintain Ford’s Colony Drive.
The Board, along with legal counsel, is evaluating the extent that this decision boosts it’s position in another case against Realtec.
